Our client was crossing the street in the crosswalk with his 12 year old daughter when an “accordion” City Bus, making a right hand turn, struck our client in the crosswalk and ran over his legs. Client suffered multiple fractures to his feet and ankles, requiring surgery. Despite patent responsibility, the Bus Driver testified at deposition that the our client walked out from between two cars in the middle of the block and that the driver was not responsible for the accident. An investigation immediately after the accident, however, revealed our client’s blood stains on the edge of the crosswalk. MSG also secured an eye witness who had been a passenger on the bus at the time of the accident. At the time of trial, the witness told the jury that she had seen the bus striking our client and running him over and, further, that she had to scream out to the bus driver to stop. Our client’s daughter also testified at trial and various photographs were displayed depicting the scene and the severe nature of our client’s injuries. The defendant capitulated to our demand and paid $2,000,000 to our client to resolve the case before the verdict.
